Preparing for your family court appearance

On Behalf of | Aug 8, 2023 | Divorce

Things like divorces and custody cases go to family court. That might make you feel panic. You probably do not know much about trial procedures. Your spouse could take your children, money or home if you are not prepared.

Fortunately, you do not need to feel panicked. Preparing properly is the key to showing up feeling confident and having proceedings go in your favor. Here is what you need to know to prepare for your trial.

Evidence

Despite what the TV shows do, you cannot just show up in court with your witnesses and evidence. You must present all of your evidence well before your trial. The goal is to get cases to settle without a trial. So make sure that you submit all your evidence well in advance. That includes a list of witnesses you plan to call on to testify. Include their names, phone numbers, addresses and what they are going to share with the judge.

Give copies of your evidence to the court and the other party. If you discover any other evidence, such as something proving your ability to care for your children, make sure to document it with the court before your trial. You are not allowed to ambush anyone with undocumented evidence, so make sure you disclose anything you plan to use.

Financial disclosure forms

File your financial disclosure forms with the judge a week ahead of your trial. To do this, you will need your last three pay stubs.

Be on time for your trial. Remain professional with your ex-spouse. Look nice to appeal to the jury. Stay polite during your interactions. Following all of these tips and preparing properly will help you have a better chance of a favorable outcome at your trial.
